Exciting news for #HealthcareProfessionals in #Maryland! On April 6th, The Maryland General Assembly passed #HB1388, which will significantly impact #noncompete provisions in #employmentcontracts.Starting July 1, 2025, non-compete provisions will be banned for #Physicians making $350,000 or less annually and providing direct patient care. These non-competes will be #void whether or not the agreement was signed within the state. Additionally, the bill introduces new requirements for employers to inform #patients when a healthcare professional subject to these restrictions shifts to a new practice location. As a related update, on April 18th, Federal Agencies; #FTC, #DOJ, and #HHS, launched HealthyCompetition.gov, an online portal for public reporting of #anticompetitive practices in the #healthcaresector, enhancing #transparency and #accountability.DLA Piper, Economic Innovation Group, Federal Trade Commission

American Medical Association (June 2023):"Noncompete clauses are extensive in healthcare, affecting between 37% and 45% of physicians."Noncompetes go beyond medical care and affect both human and animal health care, including dental care and veterinary care. These clauses have sparked a significant debate over their impact on health care and its workers as well as the quality of care provided to patients. On April 23, 2024 the Federal Trade Commission voted to finalize a new rule to prohibit employers from enforcing noncompetes against workers.According to the FTC one in five Americans, totaling nearly 30 million people, are subject to noncompetes. The FTC determined that noncompetes are an unfair method of competition and therefore violate Section 5 of the Federal Trade Commission Act. - The final rule prohibits employers from entering into new noncompetes with workers on or after the effective date. - The rule also prohibits employers from enforcing existing noncompetes with workers other than senior executives. The American Hospital Association, a critic of the FTC's decision and rule, said in a statement "The only saving grace is that this rule will likely be short-lived, with courts almost certain to stop it before it can do damage to hospitals' ability to care for their patients and communities."In this episode of The Risky Health Care Business Podcast, I am joined by Kimberly Ruppel, partner at Dickinson Wright in Michigan and Chair of Dickinson Wright’s Healthcare Litigation and Telehealth Task Forces. Here Kim talks about noncompetes and risk in health care; information and background on noncompetes; the April 23, 2024 Federal Trade Commission decision and final rule prohibiting noncompetes; strategies, tactics, and tools for now and in the future, like confidentiality agreements, employment agreements, nondisclosure agreements; and more.Thank you, Kim!Please join us and listen here:https://lnkd.in/gzRS8fkxAlso, the FTC will host a webinar on May 14, 2024, at 11a.m. ET to provide an overview of the FTC’s final rule banning noncompetes, which will include information on how to comply with the rule after its effective date.A link to the webinar will be available on the day of the event, shortly before the webinar starts via FTC.gov. The webinar will be recorded, and the webinar will be available on the FTC’s website after the meeting. Here is the FTC webinar press release: https://lnkd.in/gHj5i4KN#healthcarerisk #noncompete #healthcare #dentalcare #medicalcare #veterinarycare #springparker

With #regulations establishing various #penalites and disincentives when it comes to #infoblocking, the urgency for understanding how the regulations operate should be high for #healthcare organizations. In particular, the info blocking rule contains 8 specific exceptions for activities that do not constitute info blocking, which allow for delaying access in certain instances. Each exception is nuanced and requires a case by case assessment, which makes sense since the goal of the regulation is to enable access. However, the nuance also means that there is a lot to parse through when it comes to establishing policies and procedures. Take the time get it right now before it becomes a bigger problem. https://lnkd.in/epdsnZmd

WELL SAID! I truly appreciate Chris Deacon sharing this!Separate yet related, I have a personal experience where an Anthem Provider (LiveHealth Online) was directing me to HIGH COST CARE! I KNOW Urgent Care is the place to go for a 🤒 High Fever, YET I was advised (by the virtual doctor's personal bias) to go "straight to the ER". (TIP: I chose Virtual Care as I believed I had a sinus infection, which is a condition treated through virtual care when 👩🏽⚕️ PCP is unavailable.)🤯Get this❗ ER was still the recommendation EVEN after I expressed my concern with the HIGH COST after an open conversation about my condition. 🙌 Thankfully (even with 103 fever) I knew better.BUT I recognize not everyone has the insight + courage to fully advocate for themselves (while sick) when a Doctor is telling you otherwise.I did all the right things, which ultimately saved ME 💲 and definitely saved the Health Plan 💲. Annnd, I was home with meds in 40 minutes!📢 I cringe 😤 thinking about all the overpayment 💰 taking place, the hard working Employees 🙋🏽♀️🙋🏾♂️🙋🏻♀️🙋♂️ who lose their paycheck 💵 , and the Employers who ultimately face unsustainable premium increases 📈 as a result! 💪 THIS is why I do what I do!#strategydriven #futurefocused #employeebenefits #employeeexperience #journeyahead JA Benefits
